Terms of Service

1. Agreement to Terms
By accessing or using Humanity Says ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 13 years of age to use the Service. By creating an account or submitting an entry, you represent that you are 13 or older. If we learn that a user is under 13, we will promptly delete their account and associated data.
If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that you have your parent or legal guardian's consent to use the Service.
3. Accounts and Access
You may create an account using a magic link (email) or Google sign-in. You are responsible for maintaining the security of your email account, as it controls access to your Humanity Says account.
You may also submit entries without creating an account. Anonymous submissions do not require sign-in but are still subject to these Terms.
4. User Content
4.1 Your Copyright
You retain full copyright and ownership of the diary entries and photos you submit. We do not claim ownership of your content.
4.2 License Grant
By submitting an entry, you grant Humanity Says a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to:
- Display your entry on the Service (website, apps, feeds).
- Include your entry in compiled archives and printed volumes donated to libraries worldwide.
- Use your entry in aggregate statistics (mood maps, word counts, insights).
- Analyze your entry using AI for mood classification, language detection, and content moderation.
When your content appears in print or public archives, only the entry text, date, country, and mood are included — never your email, account details, or precise location.
4.3 Entry Immutability
Entries are designed to be a permanent record and cannot be editedafter submission. This is intentional — Humanity Says is a time capsule, not a blog. If your entry contains factual errors about your personal data, you may request a correction by contacting privacy@humanitysays.com.
You may delete your entire account and all associated entries at any time through the "My Entries" page.
4.4 Anonymous Entries
Selecting "anonymous" means your display name will not be shown publicly alongside your entry. Your entry text, location data, and metadata are still stored and processed as described in our Privacy Policy. If you are signed in, the entry is linked to your account internally.
5. Prohibited Content
You may not submit content that:
- Contains hate speech, threats, or incites violence against any person or group.
- Includes sexually explicit material or content depicting minors.
- Contains another person's personal information (names, addresses, phone numbers, etc.) without their consent.
- Promotes self-harm or suicide.
- Is spam, advertising, or commercially motivated.
- Infringes on another person's intellectual property rights.
- Is intentionally false or misleading.
We reserve the right to reject, remove, or flag any content that violates these rules.
6. Content Moderation
All entries undergo automated AI moderation before publication. Our moderation system checks for hate speech, explicit content, personal information, spam, and self-harm indicators. Entries may also be reviewed by human moderators.
Entries that fail moderation are rejected and will not appear on the public feed. You can see the status of your entries in My Entries. If you believe your entry was incorrectly rejected, you may appeal by emailing privacy@humanitysays.com with your entry ID.
The community may also flag entries for review. Entries that receive multiple flags are temporarily held for moderation.
7. Donations
Donations are voluntary contributions to support the Humanity Says mission. Donations are non-refundable and are processed securely through Stripe. Donation receipts are provided by Stripe at the time of payment. Donations do not grant any special access, privileges, or services beyond supporting the project.
8. Account Termination
By you:You may delete your account at any time through the "My Entries" page. This will permanently delete your account, all your entries, photos, and subscriber records.
By us: We may suspend or terminate your account if you violate these Terms, submit prohibited content repeatedly, or engage in behavior that harms the Service or its community. We will make reasonable efforts to notify you before termination.
9. Intellectual Property
The Humanity Says name, logo, website design, and underlying code are owned by us. You may not copy, modify, or distribute any part of the Service without our written permission. User-submitted content remains the property of its authors (see Section 4.1).
10. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by applicable law, Humanity Says shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use of the Service.
We are not responsible for the content submitted by users. Views expressed in diary entries are solely those of their authors.
11. Indemnification
You agree to indemnify and hold harmless Humanity Says and its operators from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, your submitted content, or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the United States. Any disputes arising from or relating to these Terms or the Service shall be resolved in the courts of the United States.
13. Changes to These Terms
We may modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. For significant changes, we will make reasonable efforts to notify registered users.
